UFC lightweight Josh Neer will be able to fight at UFC 101 after a judge suspended his sentence for a January drunk-driving arrest. Neer was arrested on January 1st after he hit a police car and fled the scene. The incident led to a 15 minute police chase before they were able to stop Neer’s car. Neer pleaded guilty to second-offense OWI and eluding or attempting to elude a police vehicle. As long as he fulfills terms of his probation, he will not receive jail time.

Neer’s manager, Mickey Dubberly of KO Dynasty, released this statement:

We are very pleased with the decision the judge made on Josh’s hearing, and we can now finally put this matter behind us and move on. In no way will the judge’s decision keep Josh from fighting in UFC 101. Josh has been training very hard for this fight and is looking forward to putting on a great fight for the UFC and the fans.

Neer fought at UFC Fight Night 17 six weeks after the arrest and submitted Mac Danzic. The fight earned Neer an additional $30,000 for “Fight of the Night.”  The win evened up his UFC record at 4-4, and brought his MMA record to 25-7-1. After the victory, he signed a new four-fight contract with the UFC. His next contest is set for UFC 101 against Kurt Pellegrino.
